1. Acceptance of Terms
By accessing or using MyHomestay ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms apply to all users of the Platform, including homestay owners ("Property Owners"), their staff members ("Staff"), and guests making bookings ("Guests").
2. Description of Service
MyHomestay is a software-as-a-service (SaaS) platform that enables homestay and small lodging owners in India to manage their properties, bookings, guests, and payments digitally.
The Platform provides:
- Property and room management tools
- Online booking widget for guests
- Payment tracking (UPI-first, manual verification)
- Guest communication via SMS and WhatsApp
- Analytics and reporting dashboard
- Staff management with role-based access
3. User Accounts
3.1 Registration
To use the Platform as a Property Owner, you must register using a valid Indian mobile phone number (+91). Authentication is performed via One-Time Password (OTP) sent to your registered phone number. We do not use email/password authentication.
3.2 Account Security
You are responsible for maintaining the confidentiality of your phone number and any OTPs received. You agree to immediately notify us of any unauthorized use of your account.
3.3 Account Types
- Property Owner: Full access to own property data and settings
- Staff (Helper/Manager): Limited access as defined by the Property Owner
4. Subscription Plans & Billing
4.1 Plans
The Platform offers the following subscription plans:
- Starter: ₹999/month - 1 property, 5 rooms, 1 staff member
- Professional: ₹2,499/month - 3 properties, 15 rooms, 3 staff members
- Enterprise: ₹7,999/month - Unlimited properties, rooms, and staff
Annual subscriptions receive a discount of 2 months free.
4.2 Free Trial
New users receive a 14-day free trial with full access to Professional plan features. No payment information is required to start the trial.
4.3 Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All payments are in Indian Rupees (INR) and include applicable GST.
4.4 Refund Policy
Subscription fees are non-refundable. If you cancel your subscription, you will continue to have access until the end of your current billing period.
5. Property Owner Responsibilities
As a Property Owner, you agree to:
- Provide accurate information about your property and rooms
- Maintain valid licenses and permits required for operating a homestay/lodging
- Honor bookings made through the Platform
- Respond to guest inquiries in a timely manner
- Comply with all applicable laws and regulations
- Not use the Platform for any illegal or fraudulent purposes
6. Guest Bookings
6.1 Booking Process
The Platform facilitates bookings between Guests and Property Owners. A booking is confirmed only after the Property Owner verifies receipt of payment.
6.2 Payment Processing
The Platform does NOT process payments directly. Guests pay Property Owners via UPI or bank transfer. Property Owners manually verify payments received. The Platform only facilitates displaying payment instructions and tracking payment status.
6.3 Cancellations
Cancellation policies are set by individual Property Owners. Guests should review the cancellation policy before making a booking. Refunds, if applicable, are processed directly by the Property Owner.
7. Communication Consent
By using the Platform, Property Owners agree to receive transactional communications via SMS and WhatsApp. Guests provide explicit consent at booking time to receive communications related to their bookings via SMS.
Guests can opt out of communications at any time by replying "STOP" to any message received.
8. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Multi-Tenancy & Data Isolation
The Platform operates on a multi-tenant architecture. Each Property Owner's data is isolated and cannot be accessed by other Property Owners. We implement strict technical controls to ensure data separation.
10. Intellectual Property
The Platform, including its design, features, and content, is owned by MyHomestay and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
11. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHOMESTAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
We are not responsible for disputes between Property Owners and Guests, including but not limited to booking disputes, payment disputes, or issues with property conditions.
12. Account Suspension & Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activities. Upon termination, you will lose access to your account data, though we will provide a data export option where technically feasible.
13. Modifications to Terms
We may update these Terms from time to time. We will notify you of significant changes via SMS or in-app notification. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
